The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

 

 

 

As a folow-through to the investigations of the cases with the subject of the of events conveyed to the public opinion as the ,,violent actions during the street manifestations in the period 15th -19th  January 2012,

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following comments on the status of the cases until 24.01.2012:

 

Thus,

On the docket of Prosecutor's Office of Bucharest 1st District Court of Law, there were established so far, a number of 14 cases which are investigated for the offence of outrage against morality and serious disturbance of public order and safety, destruction and outrage.

We also recall that, the Prosecutor's Office attached to Bucharest 1st Court of Law is conducting investigations for the offences of  outrage against morality and serious disturbance of public order and safety, respectively, destruction in relation to the incidents that took place on the evening of 16/01/2012, hours 21:30 in Calea Victoriei area from Bucharest, against VASILE KAROL-DIETER. To be reminded that the defendant together with other 5 other persons, would have been in Calea Victoriei area from Bucharest, and would have caused scandal and also would have kicked a car, that resulted in a damaged side-mirror and wing. He was detained by the police authorities for 24 hours, being presented on 17/01/2012, before the prosecutors of the Prosecutor’s Office attached to the Bucharest 1st District Court of Law; they ordered against VASILE KAROL-DIETER the preventive measure of the obligation not to leave town for a period of 30 days and the continuation of the investigation for determining all the circumstances of the case.

The Prosecutor's Office of Bucharest 2nd District Court of registered 7 cases in which investigations are conducted for the offences of destruction, outrage against morality and serious disturbance of public order and safety.

 

In three of these cases, it was ordered against the three accused the prosecution for the offense of illegal possession of white weapons. The accused were found by the gendarmes, during the night of 19.01.2012, in possession of blunt objects. One of the accused holding a metal chain with two hooks at the ends, a defendant having a metallic chain with links; and the third accused was found in possession of a razor, with the length of 30 cm. The means of the crime were exacted by the police authorities, currently being investigated to clarify all the circumstances of the case.

After 19.01.2012, on the docket of the Prosecutor's Office attached to Bucharest 3rd District Court of Law there were registered three criminal files which are investigated for the offence of illegal possession of white weapons.

 

We recall that, the prosecutors of the Prosecutor's Office attached to Bucharest 3rd District Court of law, requested on 17/01/2012, the court for the preventive arrest of a defendant for having committed the offence of larceny.

Magistrates of the 3rd District Court of Law allowed the request of the prosecutors and issued a preventive arrest warrant of the defendant for 25 days.

The first investigations, led to the conclusions that, in the context of the incidents occurred on 15/01/2012, the defendant participated in the theft of several mobile phones displayed for sale in a work point of a mobile phone company, by destroying the windows and other assets inside.

 Continuing the investigations, during the day of 18/01/2012, prosecutors within the Prosecutor’s Office attached to Bucharest 3rd District Court of law, requested the court for the preventive arrest of another two defendants; the prosecutor's request being dismissed by the magistrates of the 3rd District Court of Law. As a charge of these two defendants it was reminded that, in the context of the incidents occurred on 15/01/2012, they participated at the theft of several mobile phones displayed for sale in a work point of a mobile phone company, by destroying the windows and other assets inside.

The prosecutors filed an appeal, and the judicial review court, that is the Bucharest Tribunal, is to give a decision in reference to this legal remedy on 25.01.2012.

 

Meanwhile, two other persons are investigated in connection with the same circumstances occurred on 15/16.01.2012. One of the accused is prosecuted for the crime of concealment, consisting in that oh having received money and goods from one of the investigated defendants, knowing that they originate from committing the offense of larceny.

Also, another defendant is prosecuted for the offense of destruction, consisting in the fact that while he was inside a mobile phone shop, on 15/16.01.2012 he destroyed several assets inside.

 

 

 Prosecutors of the Prosecutor’s Office attached to Bucharest 4th  District Court of law conduct investigations in a criminal case against the defendant CĂPĂȚÂNĂ MIHAI for perpetrating the offence of conspiracy to commit offences, outrage against morality and serious disturbance of public order and safety.

We recall that it was ordered the preventive arrest of the defendant CĂPĂȚÂNĂ MIHAI, which was charged with participating together with other persons, on 15.01.2012, at the burning of property belonging to the public domain, in the area of ​​the crossroads of Cantemir and Mărășești in the Municipality of Bucharest.

On the docket of the Prosecutor's Office attached to Bucharest 5th District Court of Law was registered a criminal case in which there are carried out investigations in connection with the incident that took place during the manifestations of protest dated 19.01.2012, regarding the illegal use of white weapons, the case being in the stage of the preceding acts.

Investigations are underway to determine all factual circumstances.

Also, prosecutors of the Prosecutor’s Office attached to Bucharest Tribunal took over, from several district prosecutor’s offices covered by the municipality of Bucharest, 7 criminal files on crimes perpetrated on the night of 15/16 January 2012, during the demonstrations held in the University Square and in nearby areas.

All the seven criminal cases mentioned are in the stage of the preceding acts, under the supervision of public prosecutors from the Prosecutor’s Office attached to Bucharest Tribunal. In this cases the hearings are performed by the judicial police officers, and there were requested and obtained, most of the audio-video recordings; judicial photos were requested and obtained with the persons identified by police authorities, during the night of 15/16.01.2012 and comparison of the people found in the case is made with those appearing in video images to have participated in the violent and destructive manifestations. There have been identified a number of 7 persons, as a result of viewing the images, other than those covering the cases presented, for which investigations are conducted.

 

The cases regard the perpetration of  some offences of illegal possession of white weapons (a person has been identified as possessing a knife), outrage against morality, serious disturbance of public order and safety, destruction, consisting in the fact that groups of dozens of people uttered offensive words and expressions, insulted the police authorities, tore metal fences separating the (traffic) lanes, threw stones, bottles, sharp objects at the persons in the area (both against those manifesting as well as against the law enforcement officers).

Also, in one of these cases from the same unit, that is the Prosecutor's Office attached to Bucharest Tribunal, there are conducted investigations against a person for having committed the offence of affront to ensigns, as he showed contempt through the action which led to the degradation of a flag waving on a public institution in the area of Colțea Hospital.

On the docket of the Military Prosecutor's Office attached to the Bucharest Military Tribunal were registered two complaints against gendarmes who secured the area and provided the public order and safety during the street demonstrations. The two injured persons that complaint against two gendarmes initially registered before the Prosecutor's Office attached to Bucharest 5th District Court of law were commissioned to the Military Prosecutor's Office attached to Bucharest Military Tribunal.

We recall also that, the prosecutors of the Prosecutor’s Office attached to Pitesti Court of Law conduct investigations against an underage defendant, (O.A. aged 17), for having committed the offences of outrage and outrage against morality and disturbance of public order and safety. He was detained by prosecutors for 24 hours and was presented to the court during the day of 17/01/2012, with the proposal of preventive arrest. The Magistrates of Pitesti Court of Law rejected the proposal of preventive arrest and the court of judicial review, that is Arges Tribunal, decided on the appeal of the prosecutors and rejected it, bearing in mind that, in relation to the facts of which he is charged, he can be investigated without deprivation of liberty.

The evidence administered in the case led to the conclusion that, on the evening of 16.01.2012, around 20:00 hours, being in the central area of ​​Pitesti Municipality, in a larger group of protesters, the defendant threw a stone in the ornamental arrangements lying in the area and broke the window of the Trade Unions’ House. Subsequently, under the same circumstances, while he was in the area of the Central Post Office of the same town, he gave a blow in the facial area to a gendarme who was on duty, causing him corporal lesions that require 15 days of medical care (nasal pyramid fracture with nasal airway obstruction).

 Investigations are underway in order to determine all the circumstances of the case and to identify the persons involved, and as we find out more, we will inform the public opinion.

We mention that at the same time, the Prosecutor's Office attached to Sibiu Local Court conducts investigations in a criminal case established on 20.01.2012, regarding the circumstances in which a person was hit by a flowerpot that was falling from a window, while he was in the group of persons participating in a street manifestation.
