Mrs. general prosecutor Laura Codruþa Kövesi brings to the public knowledge the following:
The PhD thesis Fighting against organized corruption through provisions of the criminal law refers to all the authors and the cited works, and the novelty character and the scientific value of the work have been ascertained by the PhD commission within the West University in Timisoara.
According to the methodology, the work has been posted on the site of the organizing institution, and the submitting of the work was public.
As any PhD thesis, the work contains the stage of the researches in the field until the moment of the beginning of the effective scientific research and during the whole time of the scientific research, the studied works are quoted as bibliography, without an express reference. The stage of the research in the field is not fully mentioned as a quote , and the quotation marks are used only in the case of definitions which belong exclusively to a certain author.
The thesis contains a number of 444 pages, and the fragments to which the article refers, represents aspects of generality and not of content. The information volume which the thesis contains can lead to the appearance of material typing errors, even regarding the names of some authors.
Also, some fragments, alleged as quoted without the indication of the source, are found in many articles regarding the fight against organized criminality of which I have been author or co-author and which have been published prior the year 2005, indicated in the Cv published since 6 years on the site of the Public Ministry. Some of these articles are quoted, in turn, in the works to which the article refers.
The thesis doesn’t contain the acquiring of some scientific methodology of another author, and the work indicated in the content of the article are mentioned as bibliographic source.
For example, in the content of the article it is referred repeatedly to the work of the authors Gheorghita Mateut and collaborators with the title Traffic of human beings. Offenders, victim, offence. – about which it is sustained that it was not mentioned, even if it is quoted in the content of the PhD thesis at pages 222, 225,l 224, 234, 240, 260, 273, 274, 278, 282, 284 and 290 – see
On the other hand, ion the situations in which the same quote of an author is found both in the PhD thesis as well as in another work, there has been quoted only the initial author, according to the usual redaction norms for scientific works.
Some paragraphs indicated in the article, shown to be acquired form other authors, represent actually definitions of the offences which a\re found in juridical texts and in international conventions, or evolutions of the criminality presented in the activity reports of the structures of the Public Ministry, which doesn’t form the object of copyright.
The article tries to exploit the media moment marked by the similar controversies in the last period and we differentiate our attempts to involve the Public Ministry in controversies which have no connection with the judicial activity.
Taking into account the content of the article, the general prosecutor Laura Codruþa Kövesi has requested the SUPERIOR COUNCIL OF MAGISTRATURE for defending the professional reputation.
