The Bureau for Public Information and Press within the General Prosecutor’s Office attached to the High Court of Cassation and Justice is commissioned to inform the general public concerning the following:
Pursuing the investigations on the file regarding the murdered Japanese student, prosecutors from the Forensic and Criminal Investigation Department within the General Prosecutor’s Office attached to the High Court of Cassation and Justice have forwarded today, the 11th September 2012, to the judges of the Bucharest Tribunal the file containing the proposal for extending the duration of the warrant of arrest for another 30 days period, starting with the 17th September 2012 until 16th October 2012.
The reason for the extension of the warrant of arrest is to be found in the necessity of the administration of the following means of probation: finalizing the forensic report concerning the victims M.Y., S.T., M.M., P.S., S.M., finalizing the psychiatric forensic evaluations ordered in this case, finalizing the dactyloscopical evaluations ordered in this case, finalizing the genetical forensic evaluation ordered in this case (concerning other traces and objects than the ones that were subject to the forensic genetical evaluation report mentioned above) and also the re-interviewing of plaintiffs and witnesses.
From the evidences that were administered up until this moment of the criminal investigation, the following factual situation has been identified:
The events that took place in the evening of 15th August 2012 – victim M.Y.
The evidences administered in this case until this moment of the criminal investigation showed that, in the evening of 15th August 2012, in Corbeanca, Ilfov county, in a forest area, near a public road (DN1), the defendant VLAD NICOLAE has murdered M.Y. (Japanese citizen), the cause of death being mechanical asphyxia through compression of the cervical-thorax body region.
Also, according to the evidences administered by the prosecutors from the Forensic and Criminal Investigation Department, until this moment of the criminal investigation, it shows up that the defendant VLAD NICOLAE, through acts of violence, deprived the victim of several assets (one laptop computer, one mobile telephone and a photo camera), serious clues indicating that he also committed robbery and that he performed sexual intercourse with the victim, by constraint, serious clues indicating that he also committed rape.
Events that took place in the night 5th / 6th August 2012 – victim S.T.
Based on the evidences administered in this case, there are serious clues that, before committing this actions, the defendant VLAD NICOLAE had also committed a murder (in the night of 5th / 6th August 2012, in Baloteºti, victim being S.T.).
In this case, it has been noted that, on the 6th August 2012, the victim S.T. was found deceased in her accommodation in Baloteºti, Ilfov county, showing the traces of a sexual aggression. After the autopsy, it has been established that the cause of death was mechanical asphyxia through the compression of the cervical-thorax body region.
From the investigations in this case, serious clues showed that the author of the aggression from the night of 5th / 6th August 2012 which has lead to the death of S.T. is the defendant VLAD NICOLAE, serious clues indicating that he has committed first degree murder because he has entered without any right in the victim’s accommodation and he has performed sexual intercourse with her, by constraint.
The events that took place in the night of 25th / 26th February 2011 – victim N.L.
The evidences administered in the case until this moment of the criminal investigation showed that, in the night of 25th / 26th February 2011, around 23:00 hours, an unidentified person entered without any right in the accommodation of the victim N.L., from the Ilfov county, after which – by exerting violence over her – deprived her of several assets (money and a mobile telephone) and performed sexual intercourse with her, by constraint; it has also been noted that the aggressor tied the victims hands and feet, restraining her freedom to move.
From the evidences administered in the case it has been showed that there are serious clues indicating that the perpetrator of the crimes described above is the defendant VLAD NICOLAE.
The events that took place in the night of 28th /29th April 2012 – plaintiff M. M.
According to the evidences administered in this case, it has been noted that, on the 29th April 2012, around 03:00 hours, VLAD NICOLAE has entered without any right in the accommodation of the victim M. M. from Ilfov county after which – exerting violence over the said victim – he deprived her of a mobile telephone.
The events that took place in the period May – August 2010 – plaintiff P. S.
It has been noted that during May – August 2010, VLAD NICOLAE has entered without any right, repeatedly, in the accommodation of the victim P. S. from Ilfov county after which – exerting violence over the victim – performed sexual intercourse with her (the plaintiff has not forwarded a formal complaint so that there is a cause of non-prosecution the rape), in this case investigations being carried concerning the crime of violation the privacy of a person’s home.
Events that took place on 24th February 2012 – victim S. M.
It has been noted that, on the 24th February 2012, around 21:00 hours, an unidentified person entered without any right in the accommodation of the victim S.M. from Bucharest after which – exerting violence over the victim – deprived the victim of several assets (money and jewelry) and performed, by constraint, sexual intercourse with her.
Events that took place on the 1st March 2012 – victim A.A.
It has been noted that on the 1st of March 2012, around 20:30 hours, an unidentified person entered without any right in the accommodation of the victim A.A. after which – exerting violence over the victim – deprived the victim of several assets (money and food) and constrained her to sexual intercourse.
We remind that the prosecutors of the Forensic and Criminal Investigation Department have ordered:
Changing the juridical qualification of the murder crime for the defendant VLAD NICOLAE from murder provided by art. 174 of the Criminal Code pertaining to art. 175 paragraph 1 letter i) from the Criminal Code to qualified murder and very serious murder provided by article 174 from the Criminal Code pertaining to art. 175 paragraph 1 letters i) and h) from the Criminal Code and to art. 176 paragraph 1 letters c) and d) from the Criminal Code (regarding the acts committed on the 15th August 2012 – victim M.Y.)
Extending the investigations, starting of the criminal prosecution and starting the criminal action against VLAD NICOLAE, as follows:
- concerning the qualified and very serious murder, as provided by art. 174 of the Criminal Code pertaining to art. 175 paragraph 1 letters i) and h) from the Criminal Code and to art. 176 paragraph 1 letters c) and d) from the Criminal Code, robbery as provided by art. 211 paragraphs 1 and 2 letters b) and c) from the Criminal Code and rape as provided by art. 197 paragraph 1 from the Criminal Code ( regarding the acts committed on the 15th August 2012 – victim M.Y);
- concerning the qualified murder as provided by art. 174 of the Criminal Code pertaining to art. 175 paragraph 1 letter h) of the Criminal Code, rape as provided by art. 197 paragraph 1 of the Criminal Code and violation of the privacy of a person’s home as provided by art. 192 paragraphs 1 and 2 of the Criminal Code (regarding the acts committed on the night of 5th / 6th August 2012 – victim S.T.);
- concerning the acts of rape, as provided by art. 197 paragraph 1 of the Criminal Code, robbery as provided by art. 211 paragraphs 1 and 2 letter b) and paragraph 21 letters b) and c) of the Criminal Code, illegal deprivation of freedom as provided by art. 189 paragraphs 1 and 2 of the Criminal Code and violation of the privacy of a person’s home as provided by art. 192 paragraphs 1 and 2 of the Criminal Code (regarding the acts perpetrated on the 25th February 2011 – victim N.L.);
- concerning the acts of robbery, as provided by art. 211 paragraphs 1, 2 letter b) and 21 letter c) of the Criminal Code, and violation of the privacy of a person’s home, as provided by art. 192 paragraphs 1 and 2 of the Criminal Code (concerning the acts perpetrated on the night of 28th / 29th April 2012 – victim M. M.);
- concerning the acts of continuous violation of the privacy of a person’s home, as provided by art. 192 paragraphs 1 and 2 of the Criminal Code, with the application of art. 41 paragraph 2 of the Criminal Code (regarding the acts perpetrated during May – August 2012 – victim P.S.);
- concerning the acts of rape, as provided by art. 197 paragraph 1 of the Criminal Code, rape, as provided by art. 211 paragraphs 1, 2 letter b) and 21 letter c) of the Criminal Code and violation of the privacy of a person’s home as provided by art. 192 paragraphs 1 and 2 of the Criminal Code (concerning the acts perpetrated on the 24th February 2012 – victim S.M.);
- concerning the acts of rape, as provided by art. 197 paragraph 1 of the Criminal Code, robbery as provided by art. 211 paragraphs 1, 2 letter b) and 21 letter c) of the Criminal Code, illegal deprivation of freedom, as provided by art. 189 paragraphs 1 and 2 of the Criminal Code, and violation of the privacy of a person’s home, as provided by art. 192 paragraphs 1 and 2 of the Criminal Code (regarding the acts perpetrated on the 1st of March 2012 – victim A.A.).
The defendant VLAD NICOLAE has been arrested for a period of 29 days, starting with 19th August 2012, being investigated for having perpetrated: qualified murder, qualified and very serious murder, violation of the privacy of a person’s home, rape, robbery and illegal deprivation of freedom.
Investigation continues in order to establish all the factual circumstances and the judicial responsibility.
