PRESS RELEASE

 

 

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

 

The prosecutors of the Prosecutor’s Office attached to Bucharest Tribunal have closed the investigations and ordered, on 29.02.2012, the indictment of the following defendants:

 

Ø     GRĂDINARU FĂNICA (in preventive arrest) for committing aggravated and extremely aggravated attemptive murder (2 acts), as well as the offence of child maltreatment (2 acts) and an offence of forgery;

Ø     GRĂDINARU MITICĂ for committing the offences of association for aggravated and extremely aggravated attemptive murder (2 acts), as well as the offence of association for child maltreatment (2 acts);

Ø     MOISE ANA-DANIELA for committing the offences of intellectual forgery (2 acts), forgery of official documents (2 acts) and the offence of labor negligence;

Ø     CONSTANTIN MARINELA for committing the offences of intellectual forgery (20 acts), forgery of official documents (10 acts) and the offence of labor negligence;

Ø     POPESCU MARIA for committing the offences of abuse against the interests of persons, aggravated abuse, intellectual forgery, supporting the offender and failure to notify the judicial bodies;

Ø     PANDELE VIORICA for committing the offence of labor negligence (2 acts) and the offence of failure to notify the judicial bodies;

Ø     MITIŞOR ANA-CRISTINA for committing the offence of intellectual forgery (2 acts).

 

From the evidence administered in the case, during the investigations, it is notable the fact that, during October 2007 – 11.12.2009, in association with the defendant Grădinaru Mitică, the defendant Grădinaru Fănica (foster care assistant), exercised various acts of violence and cruelty on the injured parties (underaged of 4 and 8 years old).  Thus, the latter placed them with their heads in the toilet and flushed the water, hit their heads against different objects, soaked them in the tub holding their heads under the water, exposed them at night to low temperatures by keeping them undressed outside. Additionally, the injured part P.C.A. was hit all over the body with a wooded bat by the defendant Grădinaru Fănica, scalded, cut in the intimate parts and on the left arm, injuries that were treated superficially, favoring their infection.   

At the same time, through the violent and cruelty acts mentioned above, as well as other actions (inappropriate feeding, obliging the injured parts to answer to a different name and relate untruthful aspects regarding the suffered injuries, total neglect of school activities of the injured parts, inclusively by submitting fake id-s at the General Directorate of Social Assistance and Child Protection – Ilfov in order to justify the absence of the injured part P.C.A. from the kindergarten), the defendant seriously endangered the physical, intellectual and moral development of the injured parts.

The defendants Constantin Marinela, Pandele Viorica and Moise Ana-Daniela (social workers within Ilfov County Council – same directorate), have drawn fake visiting and assessment reports, recording in an unreal manner that they visited both children at the residence of the foster care assistant and that the injured parts were in good health, the reports being drawn without having visited the injured parts.

The defendant Popescu Maria, as a psychologist within the General Directorate of Social Assistance and Child Protection – Ilfov, during December 2008-11.12.2009,  did not fulfill her job attributions in a proper manner with regard to the psychological assessment of the injured parts and of the foster care assistant Grădinaru Fănica, and during 11.12.2009 - 08.04.2010, the ones regarding the counseling of the injured parts P.C.A., causing a significant harm to the children’s rights to life, physical integrity and harmonious physical development.

On 10.10.2011 and 14.10.2011, taking advantage of her psychologist role, of the manipulation techniques that she knew and of the fact that due to her attributions she established contact with the injured parts, the defendant Popescu Maria intimidated the injured part M.M. so that she would declare in front of her, of the foster care assistant M.F. and of the employees of the General Directorate of Social Assistance and Child Protection – Ilfov that  they  were not submitted to violent and cruelty acts by the defendant Grădinaru Fănica, thus helping her (the defendant), by obstructing the execution of criminal investigation for committing of the offences of aggravated and extremely aggravated attemptive murder, and child maltreatment.

Also, the defendant has not fulfilled in a proper manner her job attributions regarding the counseling of the injured parts on 10.10.2011, causing a significant harm to the children’s rights to life, physical integrity and harmonious physical development, and has made inappropriate statements of the truth in the report regarding the injured part M.M. from 17.10.2011.

The defendant Mitişor Ana-Cristina, as family doctor of the underaged P.C.A., has made inappropriate statements of the truth in the medical letters addressed to the General Directorate of Social Assistance and Child Protection – Ilfov and registered in this institution, referring to the examination of the underaged and to the lack of maltreatment marks.

The defendants Popescu Maria and Pandele Viorica, although even from 09.06.2010 knew about committing the offences of inflicting maltreatment to the underaged by the defendant Grădinaru Fănica, they didn’t notify the prosecutor or the prosecution bodies.

The file has been submitted, for competent settlement to Bucharest Tribunal.
