PRESS RELEASE

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

On October 18, 2011, prosecutors from the Prosecutor’s Office attached to the Bucharest Tribunal closed the indictment for the prosecution, under pretrial arrest, of the defendant Daniel NICOLAE for rape and incest.

The evidence produced in the case during the criminal investigation showed that, between August 2010 and June 18, 2011, the defendant had sexual intercourse with his daughter (11 years and 9 months old) by force and taking advantage of her incapacity to express her will.

The psychiatric legal medicine examination report diagnoses the minor with mixed anxious depressive disorder, with a direct causality relation between the sexual and emotional abuse suffered and the above mentioned disorder.

Following the notification formulated by the General Directorate for Social Assistance and Child Protection of District 2, Bucharest, the court ruled that the child be placed with her maternal grandparents, establishing the minor’s residence at the their home for the duration of the placement.

The case falls under the jurisdiction of the Bucharest Tribunal.
