The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:
On September 5, 2011, the prosecutors from the Prosecutor’s Office attached to the Neamþ Tribunal closed the indictment for the prosecution under pretrial detention of the defendant Constantin AMOªNEAGULUI for rape and incest. Between 2005 and 2010, the defendant repeatedly performed sex acts on his minor daughter.
The evidence produced during the criminal investigation showed the following facts:
The injured party, A.E.A., aged 12, lived together with the defendant Constantin Amoºneagului, her father, in the latter’s aunt’s house located in a village in the Neamþ County. The minor had been placed in her father’s care after having been abandoned by her natural mother at the age of 2.
Starting 2005 when the victim was 6 years of age, the defendant, due to alcohol intoxication, made her have normal sexual intercourse with him. This went on until the spring of 2010 when the minor became old enough to realize that she was the victim of abuse and start protecting herself by trying to stay away from the defendant when he would try to submit her to the same abuse. The defendant’s behavior was also favored by the lack of reaction on the part of other members of the parties’ family.
Although she was not aware of the implications of the defendant’s acts, the victim sensed them however as traumatizing and, starting the age of 7, she began telling the defendant’s aunt (aged 75) about this but the latter did not believe her. The only step she took was to take the minor to sleep with her in her own room but only when the minor turned 9. She also warned the defendant to stop his abusive behavior but the latter threatened his aunt with death. Even afterward, the defendant would have sexual intercourse with his daughter when the aunt was away from home.
The criminal investigation authorities were notified only on August 11, 2011 by a representative of the tutelary authority from the local village hall when the facts became known outside the family circle due to the victim’s confession to some of her school mates.
The legal medical examination revealed that the underage victim had been deflowered but the time when the act took place could not be determined.
The criminal proceedings against the defendant were instituted by prosecutor’s order on August 11, 2011, and a request was submitted to the court for a 29-day pretrial arrest of the defendant. The Neamþ Tribunal granted the Prosecutor’s Office request and issued an arrest warrant against the defendant on August 12, 2011.
The file was forwarded to the Neamþ Tribunal which has jurisdiction over the case.
