PRESS RELEASE

 

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

 

The prosecutors  of the Section for criminal pursuit and forensic within the Prosecutor’s Office attached to the High Court of Cassation and Justice have ordered the beginning of the criminal pursuit against the following accused for committing the offence  of conflict of interests, so:

 - RADAN MIHAI (former deputy in the Romania Parliament, 4 material acts), holding as factual situation that, during 17.10.2006 – 15.12.2008, in his quality as deputy  in the Romanian Parliament, the accused proposed and advised the employment within his  parliamentary office of his son (as referent, respectively as head of cabinet), as well as of his daughter in law (as counselor).

Also, at the same time, the accused concluded with his wife  a civil contract, having as object the carrying  out by the last one of some activities, paid by the Chamber of Deputies.

- LONGHER GHERVAZEN (deputy in the Romanian Parliament)  holding as factual situation that on 30 December 2004, at the proposal  of the accused, the Chamber of Deputies has employed his brother, through an individual  employment contract, for a determined period, advised  by the deputy himself, contract which was  subsequently  prolonged.

We mention that in this last case, the First Deputy of the General Prosecutor of the Prosecutor’s Office attached to the High Court of Cassation and Justice rejected, by ordinance, the solution of non-prosecution which was  ordered initially.

We also mention that the  initiation of the criminal pursuit is a phase  of the criminal process regulated  by the  Criminal Procedure Code, aiming at the creation of the  procedural framework for administration of evidence,  activity which cannot, in any case, infringe the  principle of presumption of innocence.
