In connection to the events known to the  public opinion as „violent actions during the street manifestations”

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

 

 

 

The Prosecutor's Office attached to Bucharest 1st District Court of Law is conducting investigations in a case for the offences of outrage against morality and serious disturbance of public order and safety, respectively, destruction in relation to the incidents that took place on the evening of 16.01.2012, 21:30 hours, in Calea Victoriei area from Bucharest.

According to the minute issued by the constabulary, it was concluded that VASILE KAROL-DIETER would have been together with 5 other persons and in Calea Victoriei area from Bucharest, and would have caused scandal and also kicked a car, which resulted in a damaged mirror and wing.

All the above-mentioned 6 persons were identified and led to Police Station No. 1, during 16.01.2012 yesterday’s evening. The 5 persons were audited as witnesses, as the administered evidence of the investigations did not show until the present moment that they were involved in the disturbance of public order and safety or that they had anything to do with the damaged  automobile; Vasile Karl Dieter was detained by the police authorities for 24 hours, being brought today, 17/01/2012, before the prosecutors of the Prosecutor’s Office attached to the Bucharest 1st District Court of Law with the proposal for preventive arrest.

The reasonable indications regarding Vasile Karol Dieter are yet to be profiled, as the identified and heard witnesses (different people from the 5 ones mentioned above) were not able to specify relevant elements referring to the disturbance of public order and safety; and the destruction offence (for which it was issued a provisional complaint by the owner, being an offence investigated at the provisional complaint of the injured person) for which the reasonable indications for committing the offence were profiled by the detained person, is sanctioned with limits of punishment under 4 years, thus not being complied the lawfulness requirement to be able to propose the preventive arrest.

In this context, the prosecutors of the Prosecutor’s Office attached to Bucharest 1st District Court of Law ordered the police authorities to complete the evidence of the case, and therefore they did not assimilate the preventive arrest proposal of the person named Vasile Karol Dieter.   

Investigations are underway to determine all the circumstances of the case, and as we find out more, we will inform the public opinion.
