PRESS RELEASE

 

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

 

On June 28, 2012, prosecutors from the Criminal Investigation and Criminalistics Section within Prosecutor’s Office attached to the High Court of Cassation and Justice closed the indictments and launched the criminal prosecution against the following defendants:

Valer FAUR for inspecting and building a construction without observing the technical specifications regarding stability and strength, causing the death of the victim C.A.S., seriously impairing the body integrity of 7 injured parties, destruction, negligent bodily injury (10 facts), forgery in deeds by private signature and abuse of office with very serious consequences;

Gheorghe Răsvan ENACHE for inspecting and building a construction without observing the technical specifications regarding stability and strength, causing the death of the victim C.A.S., seriously impairing the body integrity of 7 injured parties, destruction, negligent bodily injury (10 acts), forgery in deeds by private signature, abuse of office with very serious consequences and instigation to abuse of office with very serious consequences;

Eugen GEORGESCU for abuse of office with very serious consequences, instigation to forgery in official deeds, involuntary manslaughter, negligent bodily injury (17 acts) and negligent destruction with very serious consequences;

S.C. BERG SISTEM GAZ S.A. for designing, inspecting and building a construction without observing the technical specifications regarding stability and strength, causing the death of the victim C.A.S., seriously impairing the body integrity of 7 injured parties, destroying the building located on Corneliu Coposu street in Sighetu Marmației, and negligent bodily injury (10 acts);

Daniel RÎȘNOVEANU for involuntary manslaughter, negligent bodily injury (17 acts), negligent destruction with very serious consequences, and forgery in deeds by private signature;

Vasile DOLCA for involuntary manslaughter, negligent bodily injury (17 acts), negligent destruction with very serious consequences, forgery in deeds by private signature and abuse of office with very serious consequences;

Alexandru PAL for forgery in official deeds;

Daniel ULICI, Daniela PĂTRĂUȘ (formerly MICHNEA), Adrian-Ștefan PĂTRĂUȘ, and Alexandru Marius ȚIPLEA for forgery in deeds by private signature;

Petru-Andrei LAZARCIUC for forgery in deeds by private signature and instigation to forgery in deeds by private signature.

The evidence produced during the criminal investigation revealed the following.

On the night between February 18 and 19, 2012, around 1:00 AM, an explosion took place in a club located on a central street in the municipality of Sighetu Marmației. The preliminary investigation revealed that the explosion was triggered in the lavatory of the premises when the seven young girls inside attempted to light their cigarettes using an open fire source (a lighter).

An investigation team formed of employees from the Maramureș County Police Inspectorate and the Sighetu Marmației Police, the Maramureș Emergency Situations County Inspectorate, and representatives of the defendant S.C. BERG SISTEM GAZ S.A., the company that performed the gas supply system works in Sighetu Marmației, arrived shortly on site. The seven injured persons suffered body burns of various degrees and were taken to sanitary units in the Maramureș County and afterwards to hospitals in the capital city, by military plane.

Because the club where the explosion took place was not connected to the gas supply system, the investigation team checked other areas inside the building to find the source of the gas leak and infiltration.

On February 19, 2012 around 10:00 AM, a second explosion took place, causing the bodily injury (burns and traumas) of 14 persons who were inside the inspected area. The injured persons were taken to sanitary units within the County – Sighetu Marmației and Baia Mare – and later some of them were transferred to specialized hospitals in Bucharest. One of the injured persons who were transported to Bucharest (who suffered 1st, 2nd, and 3rd degree burns on the face, arms and legs, and thorax, on 40% of body area) died several days after the accident.

The two explosions destroyed 75% of the building.

It should be reminded that, due to the complexity of this case and to the actual circumstances which caused the bodily injury of several persons, and to the fact that the headquarters of the company involved is in Bucharest, by order of the Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice the case was taken over by the Criminal Investigation and Criminalistics Section within the Prosecutor’s Office attached to the High Court of Cassation and Justice.

The case falls under the jurisdiction of the Maramureș Tribunal.
