The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:
According to the provisions of art. 109 par. 2 of the Romanian Constitution, art. 12 and 19 of the Law no. 115/1999 regarding the ministerial responsibility, republished, and of the Decision no. 270 from 10 March 2008 of the Constitutional Court, the General Prosecutor of the Prosecutor's Office attached to the High Court of Cassation and Justice has requested the Romanian Parliament - Chamber of Deputies, the initiating of the procedures for formulating the request for commencing the criminal pursuit against the named DOBRE VICTOR – PAUL, former delegated minister for Administration within the Ministry of Administration and Interior, deputy in the Romanian Parliament, for committing the offence of abuse in office against the public interests in aggravated form, foreseen by art. 248 connected to tart 2481 Criminal Code.
In the case there exists clues that the named Dobre Victor – Paul has requested the accused Manoloiu Constantin, director of the Directorate for Persons Record and Administration of Data Bases, to draw a paper within which it was mentioned that the “Ministry of Administration and Interior cannot assume the truthfulness of the number of persons registered in the permanent election lists”, under the circumstances in which exactly this minister, through the Directorate for Persons Record and Administration of Data Bases, has been entitled by the Government of Romania through the Government Decision no. 682/07.07.2012, to select and process the data regarding the citizens with voting right, to print them out and to put them at the disposal of the mayors.
Subsequently, DOBRE VICTOR – PAUL has signed the letter no. 74619/VPD/02.08.2012, through which he has sent to the Constitutional Court the writ prepared by the accused Manoloiu Constantin, without a prior request in this regard from the side of the constitutional contentious court.
As at the moment of committing the deeds, for which the prosecutors from the Section for criminal pursuit and forensic within the Prosecutor's Office attached to the High Court of Cassation and Justice were notified ex officio, the named DOBRE VICTOR – PAUL held the position as delegate minister for Administration within the Ministry of Administration and Interior, deputy in the Romanian Parliament, the Chamber of Deputies was requested to initiate the procedures in order to formulate a request for commencing the criminal pursuit.
In the cause has been retained that, by the knowingly faulty fulfilling of the service duties, has been caused a significant disturbance of the smooth running of the institutions with competences regarding the record of persons with right to vote and have been seriously affected those social relations, the normal carrying out and development of which is not possible without the correct fulfilling of service obligations by the public officers or by other officers.
