PRESS RELEASE

The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:

Prosecutors of the Section for criminal pursuit and forensic within the Prosecutor's Office attached to the High Court of Cassation and Justice have ordered, on 08.08.2012, the  initiating of the criminal pursuit against  CABULEA IOAN NICOLAE, for committing the offence of abuse in office against the  interests of the public persons, in qualified form, foreseen by art. 248  in connection  with  art. 248¹ Criminal Code.

From the evidence brought into the cause until this moment of the criminal pursuit, it was retained the fact that the accused,  on 01.08.2012, in the exercise of his  suties, respectively, the assurance of the continuity  of the leadership of the Ministry of Administration and Interior, knowingly has faulty fulfilled the duties incumbent on the  base of the position held.

So, the accused  CABULEA IOAN-NICOAE ordered  to the accused Manoloiu Constantin – police quaestor and director of the  Directorate for Persons Record  and Administration of Data Bases, to  prepare an official document, respectively the letter no. 3479199, according to which the Ministry  of Administration and Interior cannot assume the truthfulness of the number of persons registered in the permanent election lists. Also, on 02.08.2012 the accused CABULEA IOAN-NICLAE has  signed the  official letter no. 74619/VPD addressed to the Constitutional Court of Romania, by which he sent the previous mentioned writ, which was prepared  at his order, violating the legislation in the matter.

The violation of the legal provisions in the matter are obvious, because  according to art. 5 of  the Government Decision no. 682/07/07/2012, the Ministry of Administration and Interior, through the Directorate for Persons Record and Administration of Data Bases, selects and  processes  the data regarding the citizens  with suffrage, prints out and put at the disposal  of the mayors  the updated  permanent election lists, in two original copies and copies of these in 3  copies, the accused CABULEA IOAN NICOLAE, main police  quaestor, state secretary, chief of the Department for Public Order and Security within the Ministry of Administration and Interior, during the whole duration of the national referendum, being part of the  Central Technical Commission, established by  the above mentioned decision  of the Romanian Government.

The investigations are ongoing in order  to clarify  all factual circumstances and to establish  the  judicial liability.
