PRESS RELEASE
The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following:
Prosecutors from the Section for Criminal Pursuit and Forensic within the Prosecutor's Office attached to the High Court of Cassation and Justice ordered on 06.08.2012 the initiating of criminal pursuit against MANOLOIU CONSTANTIN, for committing the offence of abuse in office against the public interests, foreseen by art. 248 in connection with art. 2481 Criminal Code.
From the evidence brought into the cause until this moment of the criminal pursuit, it resulted the fact that the accused, in his position as director of the Directorate for Persons Record and Administration of Data Bases within the Ministry of Administration and Interior has not observed the provisions of art. 5 from the Government Decision no.682/07.07.2012 for establishing of technical – organizational measures regarding the national referendum from 29.07.2012 for the demission of the President of Romania .
The letter 02.08.2012 issued by Manoloiu Constantin, subsequently sent to the Constitutional Court of Romania, contained the communication of the Directorate for Persons Record and Administration of Data Bases within the Ministry of Administration and Interior and mentioned that the Ministry of Administration and Interior “cannot assume the truthfulness of the number of persons registered in the permanent election lists, because this attribution is in the exclusive competence of the Permanent election Authority.”
On 02.08.2012, following the contradictory data which have been sent, in relation with the number of persons existing in the permanent election lists, by the involved public authorities (the National Institute for Statistics, the Ministry of Administration and Interior and the Permanent Election Authority), the Constitutional Court has decided to postpone for the date of 12.09.2012 the ruling regarding the observance of the procedure for organizing and carrying out the national referendum on 29.07.2012 for the demission of the President of Romania and for the confirmation of the results of the referendum.
Subsequently, the Constitutional Court, in order not to maintain this instability for such a long period, returned with a release, by which it announced that the decision of the Constitutional Court regarding the referendum, shall be taken on 31.08.2012.
The accused Manoloiu Constantin has eluded the legal provisions legal provisions in force in matters of its competence, knowing that he violate the law in this regard.
We remind that, by the minutes from 02.08.2012, the prosecutors from the Section for criminal pursuit and forensic within the Prosecutor's Office attached to the High Court of Cassation and Justice, were notified ex officio regarding the modality of organizing and carrying out of the referendum for the demission of the President of Romania.
The investigations are ongoing in order to clarify all factual circumstances and to establish the judicial liability.
