The Public Information and Press Relations Bureau within the Prosecutor’s Office attached to the High Court of Cassation and Justice is authorized to bring to public knowledge the following message addressed by Ms. Laura Codruţa Kövesi, General Prosecutor of the Prosecutor’s Office attached to the High Court of Cassation and Justice on Justice Day:
“It is the 6th year, when in my capacity as General Prosecutor I participate at the celebration of justice and while preparing my speech for today I tried to remember the face of Romanian justice back in 2006.
Beyond a first obvious conclusion generated by this kind of exercise – that of being 6 years older- an objective assessment will lead to the conclusion that, during this period, we made essential steps together.
The independence of justice became a reality, not just a theoretical concept, which led to an increasing rightfulness in the society.
More and more, justice has become an equilibrium factor that we need and which ensures that no one is above the law and that no one will remain unpunished.
Due to the fact that I administer an institution which acts are constantly subject to judicial scrutiny, I am in place to appreciate the depth of this evolution. I can state that, although sometimes the judges’ solutions do not correspond with our proposals, this scrutiny is essential for the rule of law.
The judicial scrutiny has become an active participant in the mutual control system of the state’s powers that shylessly verifies and censors the acts of the other authorities.
Another major change of the last years was the increasing intolerance of the system to the corruption within.
The last few years indictments and convictions have pointed out the existence of actual networks through which the act of justice could have been hijacked in the interest of certain persons. The elimination of these situations has been a key moment on the way to an actual rule of law and towards a credible justice.
Justice has proved that it cannot be ignored, a fact which concerned those accustomed with this kind of approach.
It is important to be aware of these years’ evolutions and to make sure that they remain irreversible.
The consolidation of these developments must be accompanied by the identification of the solutions to the system greatest problems – the long standing settlement of the cases and non-unitary solutions.
If we continue to ignore the needs and discontents of those to which the act of justice addresses it means to leave the judicial reform unfinished.
From this perspective we must identify the viable solutions for these problems. The increment of the resources is one of the possible solutions, but it must be combined with the simplification of the proceedings, in order to be ensured that the system is not conceived only for law practitioners, but, first for the parties.
Thus, the viable solutions within the new codes must be implemented: alternative ways to settle the cases, the opportunity principle, elements of negotiated justice and the transfer of some deeds out of the criminal area and into the administrative one. The judicial system is in need of these kind of institutions, if we wish for an efficient justice and not only clerks buried in mountains of files.
The latest attacks addressed to the justice and the pressure to which the judicial system is periodically subjected to from the outside, symbolizes in fact a measure of its success.
The fact that we all accepted the interdictions and incompatibilities that come with the magistrate position does not mean we abandoned our opinions. I congratulate all the magistrates that did not give up the fight and still believe that things can be improved, that the system can be perfectible.
Together we must consolidate the statute of the magistrate, we must be united and do not waste our energy with useless conflicts, resulted from private elations and interests. We can find solutions in order to conciliate the different ideas and visions upon the manner to act because we have a common goal and we wish to become an elite system.
Since my mandate as general prosecutor will shortly expire, please allow me to address a message of appreciation and gratitude.
We have worked together for 6 years and succeeded in transforming the Public Ministry into a professional, active and consistent institution, but especially into a courageous institution. Trough our investigations we have reached areas that seemed untouchable and investigated persons that seemed immune faced with the law. Many times, we were accused of opening files acting on political order, but the solutions given by the courts have showed that the facts were substantiated by the evidence.
By continuous and consistent effort, what we have accomplished together was validated at international level, by the positive, consistent appreciations of the European experts.
For the first time after 1990, the same management team had two consecutive mandates, which ensured the stability and the continuity. I hope that the next team will enjoy the same decisional independence that we were ensured of.
Thank you for your collaboration during these years and for the honest and hard work that you daily accomplish and I trust that you will show responsibility and professionalism in the activities you carry out.
I am honored to have been the head of a fundamental institution of the state, constituted of courageous people whom I admire, respect and value.
